These Terms of Service ("Terms") govern your use of the website barsys.com/corporate-happy-hours (the "Site") and the corporate cocktail event services ("Services") provided by Barsys Technologies, Inc. ("Barsys," "we," "us," or "our"). By accessing the Site or engaging our Services, you agree to these Terms.

1. Services Description

Barsys provides AI-powered corporate cocktail event services in the New York City metropolitan area. Our services include AI cocktail machines, professional bartending staff, premium spirits and mixers, glassware, setup, service, and full cleanup. Services are available in three tiers: Classic, Signature, and Reserve.

2. Booking & Inquiries

Submitting an inquiry through our booking wizard does not constitute a confirmed reservation. All bookings are subject to availability confirmation and a formal agreement between you and Barsys. Pricing provided through the wizard is an estimate and may vary based on final event details.

3. Pricing & Payment

Pricing is calculated on a per-person basis and varies by package tier
A 50% deposit is required to confirm your event date
The remaining balance is due 48 hours before the event
All prices are in US Dollars and subject to applicable taxes and gratuity
Recurring program members receive preferred pricing as outlined in their membership agreement

4. Cancellation & Rescheduling

7+ days before event: Full refund of deposit
48-72 hours before event: 25% cancellation fee applies
Same-day cancellation: Non-refundable, but may be rescheduled within 30 days subject to availability
Rescheduling requests are accommodated based on availability at no additional charge when made 72+ hours in advance

5. Guest Count Changes

We accommodate headcount changes up to 48 hours before the event. We will adjust staffing, spirits, and equipment accordingly. You are billed for the final confirmed guest count, not the original estimate.

6. Venue & Access Requirements

The client is responsible for providing a suitable venue space for the event
Barsys requires access to the venue at least 90 minutes before the event start time for setup
The client must coordinate building access, elevator reservations, and any required permits
Barsys will coordinate directly with building management when contact information is provided

7. Alcohol Service & Liability

Barsys carries comprehensive general liability insurance covering all events. Our bartending staff are trained in responsible alcohol service. Barsys reserves the right to refuse service to any guest who appears intoxicated. The client acknowledges that alcoholic beverages will be served and is responsible for ensuring all guests are of legal drinking age (21+).

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Barsys Technologies, Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Photography & Media

Barsys may photograph or record events for marketing and promotional purposes. If you prefer that your event not be documented, please notify us in writing at least 48 hours before the event.

10. Limitation of Liability

To the maximum extent permitted by law, Barsys shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services. Our total liability shall not exceed the amount paid by you for the specific event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Barsys, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site, breach of these Terms, or violation of any third party's rights.

12. Force Majeure

Barsys shall not be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions, pandemics, severe weather, or supply chain disruptions. In such cases, we will work with you to reschedule at no additional cost.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York County, New York.

14. Changes to Terms

We reserve the right to update these Terms at any time. Changes become effective upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
